1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Mnhomeonthelake Ltd. ("Company," "we," "us," or "our"), a corporation organized under the laws of Ontario, Canada, with its principal place of business at 33 King St W, Oshawa, ON L1H 1A1, Canada.
By accessing, browsing, or using our website mnhomeonthelake.com (the "Site"), or by booking, purchasing, or utilizing any of our aviation services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Site or services.
These Terms apply to all visitors, users, and others who access or use the Site and our services. We reserve the right to modify these Terms at any time in accordance with Section 14 below.
2. Description of Services
Mnhomeonthelake Ltd. provides exclusive aviation experiences, including but not limited to:
- Scenic aerial tours and sightseeing flights across Canada
- Private charter flight services
- Custom route planning and aviation experiences
- Aerial photography and filming services
- Special occasion flights (proposals, anniversaries, celebrations)
- Corporate aviation services and team-building experiences
- Educational and research flight support
All services are subject to availability, weather conditions, airspace restrictions, and compliance with Transport Canada regulations and other applicable aviation authorities.
We act as an intermediary between clients and certified aviation operators who hold valid Air Operator Certificates (AOC). The operational execution of all flights is exclusively the responsibility of AOC holders.
3. Eligibility Requirements
To use our services, you must:
- Be at least 18 years of age or have the consent of a parent or legal guardian
- Have the legal capacity to enter into binding contracts
- Not be prohibited from receiving services under applicable laws
- Provide accurate, current, and complete information during the booking process
- Maintain and promptly update your information to keep it accurate, current, and complete
By using our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to refuse service to anyone for any reason at any time.
4. Booking and Reservation Process
4.1 Booking Requests
All booking requests must be submitted through our Site, by email to [email protected], or by telephone at +1 905-579-4685. When making a booking request, you must provide:
- Full legal names of all passengers
- Contact information (email address and telephone number)
- Preferred dates and times for the flight
- Selected route or custom route requirements
- Number of passengers
- Any special requirements or accommodations
- Emergency contact information
4.2 Booking Confirmation
Upon receiving your booking request, we will review availability and send you a booking confirmation within 24-48 hours. The confirmation will include:
- Flight details (date, time, duration, route)
- Number of passengers
- Total price and payment terms
- Meeting location and instructions
- Cancellation and refund policy
- Weather contingency plans
Your booking is not confirmed until you receive written confirmation from us and complete the required payment as specified in the confirmation.
4.3 Passenger Information
For safety and regulatory compliance, all passengers must provide:
- Valid government-issued photo identification
- Weight information (for aircraft balance calculations)
- Medical information that may affect flight safety
- Signed liability waivers and safety acknowledgments
5. Pricing and Payment Terms
5.1 Pricing
All prices displayed on our Site are in Canadian Dollars (CAD) and are subject to change without notice. Prices shown are estimates based on standard routes and conditions. Final pricing may vary based on:
- Specific route and distance
- Aircraft type and availability
- Number of passengers
- Seasonal demand and availability
- Special requests or customizations
- Fuel costs and surcharges
- Landing fees and airport charges
- Applicable taxes (GST/HST)
5.2 Payment Requirements
Payment terms vary by service type:
- Standard Scenic Flights: Full payment required at time of booking confirmation
- Private Charter Services: 50% deposit required upon booking, balance due 7 days before flight
- Custom Routes and Special Events: 50% deposit required, balance due 14 days before flight
- Corporate and Group Bookings: Custom payment terms available upon request
5.3 Payment Methods
We accept the following payment methods:
- Major credit cards (Visa, MasterCard, American Express)
- Debit cards
- Bank transfers (for bookings over CAD $5,000)
- Certified checks (for bookings over CAD $10,000)
All payments are processed securely through encrypted payment gateways. We do not store complete credit card information on our servers.
5.4 Price Changes
We reserve the right to adjust pricing after booking confirmation in the following circumstances:
- Significant changes in fuel costs (more than 15% increase)
- Changes requested by the client to the original booking
- Additional passengers or services added after confirmation
- Extended flight time beyond the original estimate
Any price adjustments will be communicated to you promptly, and your consent will be required before proceeding.
6. Cancellation and Refund Policy
6.1 Client Cancellations
Cancellation fees apply based on the timing of cancellation:
- More than 14 days before flight: Full refund minus CAD $150 administrative fee
- 7-14 days before flight: 50% refund of total booking amount
- 3-6 days before flight: 25% refund of total booking amount
- Less than 3 days before flight: No refund available
- No-show: No refund available
6.2 Company Cancellations
We may cancel or reschedule flights due to:
- Unsafe weather conditions (high winds, low visibility, thunderstorms)
- Aircraft mechanical issues or maintenance requirements
- Pilot illness or unavailability
- Airspace restrictions or closures
- Force majeure events
If we cancel your flight, you will receive:
- Full refund of all amounts paid, OR
- Option to reschedule at no additional cost (subject to availability)
- Credit toward future services valid for 12 months
6.3 Weather-Related Cancellations
Safety is our top priority. Flights may be cancelled or postponed due to weather conditions that do not meet Transport Canada safety standards. Weather-related cancellations initiated by our pilots or operations team qualify for:
- Full refund, OR
- Free rescheduling within 12 months
The decision to cancel due to weather is made by the pilot-in-command or our operations manager and is final.
6.4 Refund Processing
Approved refunds will be processed within 10-15 business days to the original payment method. Bank transfers may take longer depending on your financial institution.
7. Safety and Conduct Requirements
7.1 Passenger Safety Obligations
All passengers must:
- Follow all instructions from pilots and crew members
- Wear seatbelts when required
- Remain seated during takeoff and landing
- Not interfere with aircraft controls or equipment
- Disclose any medical conditions that may affect flight safety
- Not consume alcohol or drugs before or during the flight
- Arrive at least 30 minutes before scheduled departure
7.2 Prohibited Conduct
The following conduct is strictly prohibited:
- Being under the influence of alcohol or drugs
- Disruptive, aggressive, or threatening behavior
- Refusing to follow safety instructions
- Bringing weapons, explosives, or dangerous materials
- Smoking or vaping on aircraft or in facilities
- Providing false or misleading information
Violation of these rules may result in immediate cancellation of your flight without refund and potential legal action.
7.3 Weight and Balance
For aircraft safety, we must maintain proper weight and balance. We reserve the right to:
- Request accurate weight information from all passengers
- Refuse service if weight limits are exceeded
- Adjust seating arrangements for balance
- Cancel or modify flights if safe weight limits cannot be maintained
8. Liability and Insurance
8.1 Limitation of Liability
To the maximum extent permitted by Canadian law:
- Mnhomeonthelake Ltd. acts as an intermediary between clients and certified aviation operators
- Operational execution is exclusively the responsibility of AOC holders
- Our total liability shall not exceed the total amount paid by you for the specific service
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for delays, cancellations, or changes caused by factors beyond our reasonable control
8.2 Insurance Coverage
All flights are covered by:
- Commercial aviation liability insurance maintained by AOC holders
- Passenger liability coverage as required by Transport Canada
- Aircraft hull insurance
We strongly recommend that clients obtain:
- Travel insurance including trip cancellation coverage
- Personal health insurance valid in Canada
- Additional liability coverage if desired
8.3 Assumption of Risk
By using our services, you acknowledge that:
- Aviation involves inherent risks
- You voluntarily assume all risks associated with flight
- You release Mnhomeonthelake Ltd. and its operators from claims arising from inherent risks
- You have the physical and mental capacity to participate
9. Intellectual Property Rights
All content on our Site, including text, graphics, logos, images, videos, and software, is the property of Mnhomeonthelake Ltd. or its content suppliers and is protected by Canadian and international copyright laws.
You may not:
- Reproduce, distribute, or create derivative works from our content
- Use our trademarks or logos without written permission
- Scrape or harvest data from our Site
- Use automated systems to access our Site
Photographs and videos taken during your flight may be used by us for marketing purposes unless you expressly object in writing.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you consent to:
- Collection of personal information necessary for booking and safety
- Sharing of information with aviation operators, insurance providers, and regulatory authorities
- Storage of information in accordance with Canadian privacy laws
- Use of cookies and tracking technologies as described in our Cookie Policy
11. Force Majeure
We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, wildfires)
- Severe weather conditions
- War, terrorism, or civil unrest
- Government actions or regulations
- Pandemics or epidemics
- Strikes or labor disputes
- Equipment failures or shortages
- Airspace closures or restrictions
In such events, we will make reasonable efforts to reschedule or provide refunds as appropriate.
12. Indemnification
You agree to indemnify, defend, and hold harmless Mnhomeonthelake Ltd., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any rights of another party
- Your negligent or intentional misconduct
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved as follows:
- Informal Resolution: Parties agree to attempt good-faith negotiation to resolve disputes
- Mediation: If negotiation fails, parties agree to participate in mediation before a mutually agreed mediator
- Arbitration: If mediation is unsuccessful, disputes shall be resolved by binding arbitration in Oshawa, Ontario in accordance with Canadian arbitration rules
- Court Action: Notwithstanding the above, either party may seek injunctive relief in court to protect intellectual property or confidential information
13.3 Jurisdiction
The courts of Ontario, Canada shall have exclusive jurisdiction over any disputes not subject to arbitration.
14. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of our services after changes constitutes acceptance of the new Terms.
We will notify you of material changes by:
- Posting a prominent notice on our Site
- Sending an email to your registered email address
- Updating the "Last Updated" date
If you do not agree to modified Terms, you must discontinue use of our services and may request a refund for unused services in accordance with our cancellation policy.
15. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.
16. Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Mnhomeonthelake Ltd.
17. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to any affiliate, in connection with a merger, acquisition, or sale of assets, or as required by law.
18. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any additional agreements referenced herein, constitute the entire agreement between you and Mnhomeonthelake Ltd. regarding the use of our Site and services, and supersede all prior or contemporaneous agreements, representations, or warranties.

20. Additional Provisions for International Clients
If you are booking from outside Canada:
- You are responsible for obtaining necessary travel documents (passport, visa)
- You must comply with Canadian entry requirements
- Prices are quoted in Canadian Dollars; currency conversion is your responsibility
- You are responsible for understanding and complying with export control laws
- Travel insurance is strongly recommended
